1. Acceptance of terms

By accessing or using CultCode (the “Platform”), available at cultcode.dev, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Platform. We reserve the right to update these Terms at any time, and your continued use of the Platform after any changes constitutes acceptance of the revised Terms. Material changes will be communicated via email at least 14 days in advance.

2. The service

CultCode is a marketplace that connects builders (individuals seeking guidance) with pros (experienced professionals who have shipped real products). The Platform facilitates the booking and payment for one-on-one sessions between builders and pros. CultCode is not an employer, staffing agency, or recruitment platform. Pros are independent participants, not employees or contractors of CultCode. The relationship between a builder and a pro is solely between those two parties, and CultCode acts only as an intermediary to facilitate the connection and handle payment processing.

3. User accounts

To use the Platform, you must create an account. By creating an account, you represent and warrant that:

• You are at least 18 years of age or the age of majority in your jurisdiction.
• All information you provide during registration is accurate, current, and complete, and you will keep it updated.
• You will maintain only one account per person. Creating multiple accounts to circumvent restrictions, bans, or payment rules is prohibited and may result in permanent suspension.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You will notify us immediately at legal@cultcode.dev if you suspect any unauthorised access to your account.

4. Builder terms

As a builder (a user who books sessions with pros), you agree to the following:

• Payment is required upfront at the time of booking. Sessions are confirmed only after successful payment.
• You may not record, screenshot, or capture any part of a session without the explicit written consent of the pro. Violation of this rule may result in immediate account termination.
• Advice, opinions, and guidance provided by pros during sessions are for informational purposes only. Pros are not acting as your employees, consultants, or legal or financial advisors. You are responsible for your own decisions and actions based on session content.
• You agree to be respectful and professional during all sessions. Harassment, abusive language, or threatening behaviour will result in immediate removal from the Platform without refund.

5. Pro terms

As a pro (a user who offers sessions to builders), you agree to the following:

• You must have demonstrably shipped at least one product, feature, or project that is publicly verifiable. CultCode reserves the right to verify your credentials and remove profiles that contain misleading or inaccurate claims.
• Your profile must accurately represent your experience, skills, and areas of expertise. Misrepresentation of qualifications is grounds for removal.
• If you need to cancel a session, you must provide at least 24 hours' notice. Cancelling within 24 hours of a scheduled session will trigger a full refund to the builder and may affect your visibility on the Platform.
• CultCode retains a platform fee of $10 per session. You will receive $39 of the $49 session price. Payouts are processed via DodoPayments within 2 business days after the session is completed.
• You are responsible for reporting and paying any applicable taxes on income earned through the Platform. CultCode does not withhold taxes on your behalf.

6. Payments

All payments on the Platform are processed through DodoPayments. By using the Platform, you agree to DodoPayments's Terms of Service.

• Each session costs $49, paid by the builder at the time of booking.
• Of the $49 session price, the pro receives $39 and CultCode retains $10 as a platform fee.
• Pro payouts are processed within 2 business days of session completion via DodoPayments Connect. Payout timing may vary depending on your bank and country.
• All prices are listed in US dollars. Currency conversion fees, if applicable, are determined by your bank or payment provider and are not controlled by CultCode.
• CultCode does not store credit card numbers or sensitive payment details. All payment data is handled and secured by DodoPayments.

7. Cancellations and refunds

Our cancellation and refund policy is designed to be fair to both builders and pros:

• Builder cancels 24+ hours before session — Full refund issued to the original payment method. Refunds are typically processed within 5–7 business days.
• Builder cancels under 24 hours before session — No refund is issued. The pro has reserved their time and may have turned away other bookings.
• Pro cancels— If a pro cancels a session for any reason, the builder receives a full refund automatically. Repeated cancellations by a pro may result in reduced platform visibility or account suspension.
• No-shows— If a builder fails to attend a booked session without cancelling, no refund will be issued. If a pro fails to attend, the builder receives a full refund and the incident is recorded.

8. Prohibited conduct

You agree not to engage in any of the following prohibited activities:

• Circumventing the Platform to arrange sessions or payments outside of CultCode, including exchanging personal contact information for the purpose of avoiding platform fees.
• Harassing, threatening, intimidating, or abusing any user on the Platform, whether during a session or through messages.
• Recording, sharing, or distributing session content without the explicit written consent of all participants.
• Creating fake accounts, impersonating another person, or providing false information in your profile.
• Using the Platform for any unlawful purpose or in violation of any applicable local, national, or international law.
• Attempting to reverse-engineer, decompile, or interfere with the Platform's technical infrastructure or security measures.
• Spamming, soliciting, or using the Platform for advertising or promotional purposes unrelated to session bookings.

9. Intellectual property

Content shared during sessions (advice, ideas, recommendations, code snippets, and other materials) belongs to the respective participants who created it. CultCode does not claim ownership over any content exchanged during sessions between builders and pros. The CultCode name, logo, brand identity, website design, and all associated visual elements are the exclusive property of CultCode and may not be used, reproduced, or distributed without prior written permission.

10. Limitation of liability

To the maximum extent permitted by applicable law, CultCode and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform. CultCode's total aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to CultCode in the 12 months preceding the claim. CultCode does not guarantee the quality, accuracy, or outcomes of any session. The Platform is provided “as is” and “as available” without warranties of any kind, whether express or implied.

11. Dispute resolution

In the event of any dispute arising out of or in connection with these Terms or the Platform, the parties agree to first attempt to resolve the matter through good-faith negotiation by contacting legal@cultcode.dev. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the matter to binding arbitration in accordance with the rules of the Indian Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English, and the seat of arbitration shall be in India. Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in India for any legal proceedings arising out of or relating to these Terms or the Platform.
